In some cases, there is no need for either formal or summary administration. If the decedent's estate consists of only property exempted by statute for creditor claims, protected by the Florida Constitutions Homestead exemption, and the remaining property is less than the amount already paid by the petitioner for qualified funeral expenses, the estate may qualify for disposition without administration. Similar to summary administration, a single petition is filed with the clerk of Court, however; estates that qualify generally will not need to notify or deal with creditors.
